We’re doing this is stages.
Stage 1 was released along with v3.0.0.60.
When you install WaveSecure, you will be prompted to install the an additional Uninstall Protection application from the Market.
In this stage, Uninstalling WaveSecure (or the Uninstall Protection App, aka UPA) will lock up the phone. If WaveSecure is uninstalled, remote server commands will not work any more. We’re planning to address this is stage 2.
If the PIN is entered on the lock screen, the assumption is that you’re a legitimate user and you really want to uninstall WaveSecure. We then prompt the user to uninstall the UPA as well.
PIN-related functions such as forgot PIN and entering a temp PIN works when the phone is locked in this manner.

Doing it like a BIOS is near impossible on commercial phones since apps don’t have access to that kind of functionality.
However, what we CAN do is to have the phone lock when it starts up. Currently we only have the option to automatically lock when the SIM is changed. We could add this as a setting. Pls vote it up if you think it should be implemented.

Thanks for the comments Roy, what about the answer to the second question. What if someone boots in to factory settings?
Does Wave secure still capture it?
